The Waqf Tribunal

The state Govt. has constituted a Waqf Tribunal U/s 83 of the Waqf Act 1995 for determination of any dispute or other matter relating to Waqf properties. The Tribunal is functioning. At present the joint Secretary of the Law Deptt. Is Presiding Officer of the Tribunal. The State Govt. has also taken a legislative measure to bring all cases of Waqfs, pending before the different Civil Courts in the Waqf Tribunal for speedy disposal.

Litigation of wokf properties ::- There are different type of cases like civil suits, Criminal cases, Misc.cases, Title suits & writs Pending in different courts and Hon'ble Patna High Court:- No of total cases-200 (Approx.) Due to the paucity of found the board is unable to make necessary parvies in these cases. According to rough estimate a sum of Rupees three lakhs is required to meet the all legal expenditure of the Board.

In this regard Board's Advocate has been directed U/s 85 "A" to take action for transferring cases pending in Civil Court to the Waqf Tribunal some cases has been transferred in the Waqf Tribunal.
